An Accra Circuit Court has dismissed an application of no case filed by lawyers for medical doctor Ali Gabass who is standing trial for allegedly sodomizing a 16-year-old boy.
Dr Ali Gabass’ lawyers had prayed the court to dismiss the prosecution’s claim and discharge the medical doctor.
According to the ruling by the court presided over by Rita Agyeman Budu, the defense were unable to discredit the evidence by prosecution witnesses and could not on the face of the evidence available grant the plea of Dr. Gabass.
She therefore ordered the lawyers of Dr. Gabass to open their defense on May 13, 2015.
Dr. Gabass is alleged to have had anal sex with victim on five different occasions.
The victim reportedly met Ali Gabass on Facebook sometime in 2013.
According to the facts of the case, in October 2013, Ali-Gabass arranged and met the victim at the Kasoa New Market area where the suspect forcibly had anal sex with the victim in his car.
The act was repeated on five occasions, after which the victim fell ill.
