Court adjourns election case to Thursday

The Supreme Court sitting in Accra on Tuesday adjourned the election dispute case it is currently handling to Thursday, May 2, 2013.

When proceedings resumed on Tuesday morning, Mr. Tsatsu Tsikata, lead Counsel for the National Democratic Congress (NDC), continued with his interrogation of Dr. Mahamadu Bawumia, second petitioner and running mate to Nana Akufo Addo, presidential candidate of the New Patriotic Party (NPP) in the 2012 general election..

Mr Tsikata tendered as exhibit, a letter said to have been written and signed by Nana Akufo Addo and asked if Dr Bawumia knew about the letter.

He further asked if witness could confirm that the letter was indeed written by Nana Akufo Addo on his own letter head.

Dr Bawumia responded that although the signature and letter head appeared to belong to Nana Akufo Addo, he was not initially aware of the presence of the letter.

He said his attention was however drawn to it later, but added that there was something curious about the letter.

He said the letter was purported to have been written on December 5, 2012 but curiously it was received on December 3, 2012 which, he said, was not normal.

Mr Tsikata presented a bunch of duplicated pink sheets which he said had been mislabeled, and that it had the potential to mislead the court.

Dr Bawumia replied that the mislabeling could only be misleading if there was no explanation, but with the explanation that the figures had been entered once, there would be no confusion about it.

Mr Tsikata countered that but for the vigilance of the respondents the court would have been misled by the so-called mislabelling.

Nana Akufo Addo, Dr Bawumia, and Mr Jake Obetsebi Lamptey who are first, second and third petitioners respectively in the landmark election petition case, are challenging the results of 2012 presidential election declared by the Electoral Commission (EC).

President John Dramani Mahama, the EC and the NDC are first, second and third respondents respectively in the case.

Hearing continues on Thursday.
