...Calls For Prosecution Of Those Responsible For The Abrogation Of The Contract
Some documents available to The New Crusading GUIDE indicate that the Ministry of Food and Agriculture after studying the report of the professional group conceded that there were some grounds on which the Ministry could have mounted a defence to the suit filed by Messrs Isofoton S. A Madrid Spain.
A letter authored by Mr. Seth Mensah Dumoga, deputy Director of Finance and administration on behalf of his Minister, Mr. Kwesi Ahwoi stated that the matters raised by the Professional Group Such as the date of contract and its non compliance with the Procurement Law etc. would have been the basis for a defence against the suit.
The letter which was responding to an earlier letter written by the A-G said the way forward may be to identify those responsible for the abrogation of the contract and charge them with willfully causing financial loss to the State.
The letter addressed to the Attorney-General and Minister of Justice on 14th June, 2011 noted amongst other things that the negotiations that we had with the plaintiff were the result of his having obtained default judgement against us at the High Court.
Published below are correspondences between the Attorney Generals office and the Ministry of Food and Agriculture.
