The Special Prosecutor has no mandate under Articles 14(1)(g) and 2, and 18 (1) and (2) of the 1992 Constitution, and the combined effect of Section 69(1) of the Office of the Special Prosecutor Act, 2017 (Act 959) and Regulation 20 of the Office of the Special Prosecutor (Operations) Regulations, 2018 (L.I. 2374) to bring a charge in a court of law against a suspect under investigation who has not been formally cautioned as a suspect, and later charged with one of the eleven (11) specified corruption or corruption-related offences as defined under Section 79 thereof for failure to comply with a notice for declaration of property and income under Regulation 20 (1) and (2) of L.I. 2374.
