Justice Kpegah's Suit Defies Tradition And Common Sense

A Deputy Communications Director of the New Patriotic Party (NPP), John Boadu, has described the law suit against Nana Akufo-Addo by Justice Francis Kpegah as one that defies tradition and common sense. John Boadu could not understand why anyone could think Nana Akufo-Addo is not the same as William Addo Danquah Akufo-Addo. He maintained that some level of restraint should be exercised in discussing Justice Francis Kpegah because of the fact that he has served as a Supreme Court Judge and also due to his old age. On Tuesday 18th of March, 2013, a former Supreme Court Judge Francis Kpegah, filed a law suit against the Flagbearer of the NPP, Nana Akufo-Addo in the just ended 2012 general elections for impersonating William Addo Danquah Akufo-Addo. He claims his checks have revealed that Nana Akufo-Addo is not the same person as William Addo Danquah Akufo-Addo, the name in the roll of lawyers which therefore makes Nana Akufo- Addo an imposter. In the writ, Justice Kpegah prayed the Court overturn Nana Akufo-Addo�s right to practice law in Ghana and listed his claims, disclosing that; �a declaration that on a true and proper interpretation of the General Legal Council Act, Act 38 of 1960 (as amended) unless a person is called to the Bar in Ghana and his name entered in the Roll of Lawyers by the body mandated under the said Act 38 (as amended) to regulate the training and certification of persons after a prescribed course of study, that person cannot be deemed competent to practice law in any court of Ghana. �A declaration that the Law Firm established as Akufo-Addo, Prempeh and Co. at 67 Kojo Thompson Road, Adabraka, Accra, is an illegal law firm and therefore not competent to represent any party in litigation before any court in Ghana". It further read. The former Judge of the Highest Court of the land further prayed the Court for, �a perpetual injunction restraining the said Nana Akufo-Addo from holding himself out as a lawyer competent to practice in the Ghanaian courts or anybody regarding him as such�. Having read Justice Kpegah�s concerns with the issue, John Boadu asked; �if Nana Addo is not a lawyer, so what�? The former youth organizer of the NPP equated the lawsuit against Nana Akufo-Addo to �being served with a summon to which one is compelled to respond, even if the issues for which you were served are irrelevant�. Speaking on Accra-based Asempa FM on Wednesday, he acknowledged the long service and the contribution of the former Supreme Court Judge to the legal fraternity and therefore called on friends and family of the Statesman to handle the issue with care in order not disgrace themselves.
