CJ, Legal Council Probe Top Lawyer! For Alleged Impersonation

The Chief Justice, Her ladyship Georgina Theodora Wood and the General Legal Council (GLC) will in the coming days, severally probe a top legal brain, Lawyer Addo Atuah, for allegedly presenting himself to a court, as counsel for the Ataa Tawiah Tsinaiatse family without their consent. The investigations have been occasioned by a petition to the Chief Justice and Legal Council dated 3rd of February, 2014, by the Ataa Tawiah Tsinaiatse and the Numo Ofoli Kwashie families of La in the Greater Accra region. In the petition, the lawful attorney for the two families, Esther Korkoi Quaye, revealed that representatives of the families on 9th May, 2006, instituted a case against the Acting Chief Registrar of Lands, Land Title Registry and the Trustees, East Dadekotopon Development Trust, La, Accra for the recovery of Land belonging to the families. The two families, ably represented by Lawyer Ivan Quansah, later, about two years into the case saw the appearance of Lawyer Addo Atuah, at the court as the counsel for the 1st Plaintiff without an official endorsement by the Heads of the family, the legal attorney noted. To the 1st Plaintiffs surprise, the petition alleged, Lawyer Addo Atuah filed a motion of discontinuing its action against the defendant on 27th February, 2008 without their consent and disappeared without stepping foot at the Court. According to Esther Quaye the action by Lawyer Addo was an attempt to connive with David Feefitee Tawiah, member of the Ataa Tawiah Tsinaiatse Family and the Lawyer for the 2nd Defendant, LSN AKuetteh who happened to bear the same address (Essie Lodge, Adabraka) as the imposter lawyer to settle the matter out of Court. With Mr. Ivan Quansah still representing us as our counsel, the Ataa Tawiah Tsinaiatse Family on December 7th, 2010 were granted a High Court Judgment in favour of the two Families to take possession of 808 Acres of Land in dispute as the Lawful owners, Ms. Quaye further revealed. In the application of letters of administration by Ivan Quansah on 3rd June, 2013 in response to an appeal motion filed by the 2ndDefendant, Adoo Atuah, without the authority of the families filed before the Court of Appeal a motion for the substitution of Edward Nsiah Akuetteh who happens not to be a member of any of the two families, Ms. Quaye observed. According to the petition, Lawyer Addo Atuah, together with the counsel for the 2nd Defendant, Lawyer LSN Akuetteh, David Tawiah, and Edward Akuetteh, who were allegedly already selling parts of the lands indiscriminately then entered into negotiations for the Plaintiffs to accept a 40.00 Acre land as against 808.4 Acres contained in the High Court Ruling even though the case was pending in the Court of Appeal. The action, Ms Quaye described as unethical and aimed at dispossessing the Plaintiffs of their land for their own selfish interest and benefit. The family attorney accused Mr. Atuah of sidelining Mr. Quansah whiles he appeared in Court each time the case was mentioned and announced himself as the Solicitor for the Plaintiff whereas he had not been appointed as such. Esther Quaye further accused David Tawiah of appearing before the Court of Appeal on 3rd June 2013 as Plaintiff, Applicant, Subtitutee and moved a motion in the absence of Lawyer Addo Atuah or any other counsel representing other parties in the case for the Substitution of the 2nd Plaintiff Familys representative in the case. Calling it very unusual as all counsels and other parties were absent, the petitioner indicated that the same David Tawiah chaired the family meeting which saw the appointment of her as the approved Lawful Attorney to handle legal issues and anything to do with Land in the family by the Head of Ataa Tawiah Family on May 27th, 2013 yet went on to move a motion without me. Ms. Quaye alleged in the petition that from the grapevine, she has heard that huge sums of monies have exchanged hands to facilitate the move by the East Dade-Kotopon Development Trust, 2nd Defendant to have the families accept 40 acres of land. She therefore prayed the Chief Justice and the General Legal Council to invite Mr. Addo Atuah to explain his conduct and to halt his interference with their Familys legal matters for the case to take its normal course.
