Suit Against The Insight Newspaper

Lawyers Make First Move lawyers of The Insight have filed appearance at the Human Right Division of the high Court in a suit filed by First Capital Plus bank.

The Bank is claiming GH5 million in general damages for libel and wants an injunction to restrain The Insight form further publication of “Private and Confidential” documents. The management of the Insight has already described the suit as an abuse of the judicial process and indicated that the newspaper will plead justification.

The Managing Editor of The Insight, Kwasi Pratt jnr. Says “you cannot collect deposits from 124,000 Ghanaians and insist on your privacy. We will meet them in court.”

The insight is being represented by Mr. Samuel M. Cudjoe of Law Trust who filed appearance on Monday, January 27.

First Capital Plus Bank is represented by Kwaku Y. Paintsil of Paintsil and Co. Goshen Chambers.

In its statement of claim the bank assert that as legal entity “it enjoys the right enshrined in the constitution of the Republic of Ghana and other relevant states, including without limitation, the right to privacy and to the enjoyment of its good reputation and a conducive atmosphere devoid of panic of its staff, its clientele and the general public to carry out its objects of incorporation.”

The Insight first published a lead story on its front page headed “Scandal-First Capital Plus Bank is collapsing January 19 2015.

This was followed by a second publication headlined “Scandal 2-Full Report on the Collapse of First Capital Plus Bank.”

The statement of claim of the bank said the publications were “defamatory and that assuming without admitting that the plaintiff Bank was going through some difficulties, the Defendants placed a malicious interpretation thereon, and as a result caused a diminution and continue to cause a diminution in the business of the plaintiff’s company.”

The legal team of the Insight is confident that it would put up an unassailable defence.
