Judge in Mahama Gunman Case Erred

A legal partitioner, Mathias Donkor has opined that Justice Francis Obiri who convicted a man for possessing a loaded gun with the intention of killing the President erred in his judgement.

The Lawyer reacting to news break that Charles Antwi has been jailed 10 years for unlawful possession of firearms argued that the Judge did not act in accordance with law.

“It is not sufficient to have jumped into a sentence…they didn’t follow criminal procedure…the judge was unfair to the suspect,” he said.

Charles Antwi who was arrested at the Ringway Assemblies of God church for carrying a loaded gun was convicted after he confessed that he went there to kill President John Dramani Mahama.

Multimedia Journalist, Kwakye Afreh-Nuamah who was at the Circuit court reported that he was charged with possession of fire arms without lawful excuse.

His confession led the court to sentence him to 10 years imprisonment despite the man pleading not guilty to the first degree felony charge of possession of fire arms.

Lawyer Donkor commenting on the charge on Adom FM’s Midday News, ‘Kasiebo is Tasty’ said he disagreed with the Judge adding that it was important for the suspect to have been made to go through full trial.

“It is totally wrong in law to sentence someone who has pleaded not guilty…he must be made to go through full trial…,” he said.

He added that the prosecutors ought to have secured a bail for the proceedings to continue to arrive at the necessary legal conclusion of the case.

“It is very wrong because you need the express consent of the Attorney General to charge him with unlawful possession of fire arms…and the case ought to have travelled the full length after he pleaded not guilty,” he said.

When asked if Charles Antwi could appeal the case, the Lawyer responded that he could apply for a certiorari for the case to be quashed as it is not supported by law.
