A-G And BNI Are Showing Selective Justice In The Criminal System - Law Professor

Law Professor Stephen Kwaku Asare says in terms of the criminal aspect of the 34 judges who have been alleged to have taken bribes in the ace investigative journalist, Anas Aremeyaw Anas�s bribery investigation, the Attorney-General and Bureau of National Investigation have failed the justice system.

According to him, the Attorney-General has done well in granting immunity to Anas Aremeyaw Anas but to him it is not enough if the judges who are involved in the crime are not arrested to take statement from them for prosecution.

Speaking on Okay Fm�s 'Ade Akye Abia' Morning Show, Professor Kwaku Asare wondered why the same energy the Attorney-General (A-G) and BNI used to arrest Amina Muhammed when she alleged she has been raped in Yutong Bus and Charles Antwi for his assassination attempt on President Mahama has not been used to arrest the judges for corruption.

�How come when the judges were implicated in criminal case, up till now, not even a statement has been taken from them from the criminal angle? There is a correct removal procedure going on but the removal process is separate from the criminal process; the criminal process has to be activated because any of those 34 people who are involved can run away from the country,� he asserted.

��the Attorney-General and other prosecutors should initiate prosecutorial activities against them; they should be arrested for them to go for preliminary hearing and let a judge grant them bail or decide otherwise until the trial is over but nothing has been done�there is a selective justice in the criminal system,� he averred.

He articulated that the BNI does not seem to be very interested in this case which bother on the democratic core that can destroy the country as compared to the trivial case of Amina Yutong saga and Charles Antwi�s.

He feared this lackadaisical attitude of the A-G and BNI is prosecuting the judges cited for corruption will kill the confidence of Ghanaians in the judiciary; believing it is due to the failure of A-G and BNI which has given the impetus to the judges to take the Chief Justice and Judicial Council to court to prevent Anas from airing the recorded video and audio.
