Supreme Court Adjourns Justice Dery's Suit Against Anas

The Supreme Court on Tuesday adjourned sine die the suit filed by Justice Paul Utter Dery against the Tiger Eye PI, the Judicial Service and the Attorney General (AG) for going ahead to air the alleged corruption video.

The high court judge caught on video allegedly taking bribe is asking the Supreme Court to dismiss a petition filed by Tiger Eye PI, a private company owned by the investigative journalist Anas Aremeyaw Anas calling for his removal.

The five- member panel of the Supreme Court, presided over by Justice Julius Ansah adjourned the case saying that the court registrar had informed the court that the first defendant, Tiger Eye PI has not been served.

He said until the defendant was served, the case could not be heard and as such the plaintiff must ensure that all parties were served before the case could be heard.

The suit was then adjourned sine die.

Meanwhile the AG has asked for an extension of time to be able to study the motion and respond accordingly.

According to Justice Dery, the petition should be declared as null and void because its contents had been leaked in contravention with Article 146 (80) of the 1992 constitution.

He is arguing that the publication of Tiger Eye PI petition to the President in the media, as well as the public screening at the Accra International Conference Centre of the video, and the Judicial Councils naming of the judges involved in the bribery scandal in a statement contravened Article 146(8) of the 1992 constitution and therefore unconstitutional.
