Zanetor Rawlings Sued

A suit has been brought against the NDC Parliamentary candidate elect for Korle-Klottey Constituency, Dr. Zenator Rawlings, for breaching various provisions of the 1992 Constitution and the internal regulations governing the conduct of parliamentary primaries of the umbrella family.

She is accused of not being a registered national voter at the time the Akatamansonians went to the polls (November 21, 2015) to elect a parliamentary candidate for the Korle-Klottey Constituency.

The umbrella family and the Electoral Commission were also joined in the suit that was filed at an Accra High Court last Friday, December 11, 2015 by Joseph Botchwey, Jacob Amin, Alhaji Mohammed Mahmoud and Rev. Michael Kwabena Nii Adjei Sowah, all members of the ruling party.

The Plaintiffs are seeking among other things; A declaration that the decision by the NDC to allow Dr. Zenator Rawlings to contest the Parliamentary Primaries in the Korle-Klottey Constituency when she was not a registered voter within the meaning of Article 94(1)(a) of the 1992 Constitution at the time of the said contest violates the Constitution and the Internal Regulations governing the conduct of parliamentary primaries of the NDC and same is illegal and of no effect;

A declaration that Dr. Zenator’s election as a Parliamentary Candidate elect for the Korle-Klottey Constituency is null and void and is of no effect as same violates the constitution of the NDC and the rules governing the conduct of the 2016 parliamentary primaries;

An Order of injunction restraining Dr. Zenator Rawlings, agents, privies, assigns or anyone claiming through her from holding herself out or allowing herself to be held out by the other defendants as the Parliamentary Candidate elect for Korle-Klottey Constituency until the matters in dispute are heard and disposed off by this Honourable Court;

An Order of court directed at the NDC for a re-run of the parliamentary primaries in Korle-Klottey constituency for the two other contestants in accordance with its constitution and the Regulation governing the 2016 parliamentary primaries within two weeks of the annulment of Dr. Zenator’s election;

Any other Order(s) as the court may deem fit; as well as cost including legal fees.

The suit, Kasapafmonline.com learned, was spurred by failed attempts by the Plaintiffs to use the internal structures of the party to get grievances addressed.
