All Eyes On High Court Judge �

Come Wednesday, 27th July, year, all eyes will be on a High Court in Accra, which as summoned Holy Quaye and Esther Korkoi Quaye, the legal attorney of the Atta Tawiah Tsinaiatse Family for allegedly ignoring a Stay Of Executioner filed by the East Dadekotopon Development Trust (EDDT) and going ahead to work with an earlier court ruling which went in their (family’s) favour.

Under the gavel of Justices R.K Apaloo, V.D Ofoe and A.M.A Dordzie, all on the Appeal’s Court, the court ordered, in the case of Edward Mensah Tawiah and Ewormienya Ofoli Kwashie Vrs the Ag. Chief Registrar of Land and the Trustees, after the former had won the case and the latter gone ahead to file a motion for Stay of Execution that, “In our view, upon hearing both counsel we are satisfied that serious legal issues have been raised the judgment of the lower court. In order that the Court of Appeal is given the opportunity to pronounce on those issues we shall stay execution so as to maintain and preserve the status quo”.

  Issues about how higher up in society have turned their attention on the Lands behind the trade fair sit have been so rampant that barley three years, except on one occasion where the legal attorney to the family, Esther Korkoi Quaye was called and informed she would be called upon to testify against the Judge, the Judiciary has developed cold feet and has failed to commence hearing on a petition fired by the family against one of the judges.

In the petition, dated 30th June 2016, the family stated that Justice D. Victor Ofoe presided over the case between the La Stool and two quarters at the High Court and gave judgement on the Terms of Settlement reached by the parties on Thursday, 12 July 2001, leading to the formation of the EDDT and that “…Justice Victor D. Ofoe should have recused himself from any case involving EDDT over the same piece of Land when it came up at the Court of Appeal”.

“It is sad to note”, the petition (published elsewhere) said, “that Justice D. Ofoe, knowing fully well that he had determined a previous case involving EDDT, did not recuse himself whenever the case came up before him at the Court of Appeal. However, he always sat on the case at the Court of Appeal”.

Citing other cases to buttress her case, Madam Korkoi Quaye, called on the Chief Justice to call the Judge to order and ensure that the law takes it course.

More so, following the petition which has delayed at the Judiciary without hearing, this paper can report that politicians, a prominent lawyer and NDC bankroller, judges, and some business men, NDC higher ups, as well as estate developers have had a field day, carving up the the land and selling it to the highest bidder.

So server is the land grabbing at the Trade Fair site, that the supposed prominent lawyer is allegedly walling even beyond a fifty- acre land under the name of the trust that was supposed to serve the whole La community and its youth.

Meanwhile, tongues are wagging and allies of Attah Tawiah Tsinaiatse Family have started question why on the many number of occasion they have been on appeal, only these Judges: Francis Kusi Appiah, Samuel K. Marful, Victor Dotse Ofoe, Francis G. Kobieh, and Emmanuel K Ayebi are the ones that sit in to hear their appeal.

This paper can report that in the coming weeks, the Chief Justice is likely to receive another petition on the conduct of some of her Lordship Justices.
