An Accra High Court has granted a substituted motion on notice for the demotion of property being put up by Overtaken Company Limited on the land of Henry Sakyi-Obiri of Ages Investment Company Ltd located at Dodowa in the Greater Accra Region.

The substituted service is to take the form of pasting of the processes and the order on the notice board of the Lands Division of the Accra High Court.

It is also to be pasted at the last known place of business of the company where the poster would remain for 14 days, as well as a single publication in one edition of a nationally circulated newspaper.

The order follows an ex parte motion filed by lawyer for the plaintiff, Eric Kwame Afriyie, for a demolition order with regard to property that might have been erected on the said land of the plaintiff.

The court, presided over by Justice Barbara Tetteh-Charway, after listening to the arguments of the lawyer for the applicant granted the order.

The plaintiff, Henry Sakyi-Obiri in 2013, secured judgement against the defendant’s company, Overtaken Company Limited with regards to the land in question.

The plaintiff, in 2015, subsequent to the judgment successfully secured a writ of possession, which was granted by Justice Barbara Tetteh-Charway.

However, the applicant, after securing the writ of possession travelled out of the jurisdiction for a considerable time, thereby causing the writ of possession to expire.

Upon his return, he instructed his lawyer to make an application for renewal of the writ of possession which was granted on June 1, 2018.

He, therefore, went back to court for an order to demolish any property that have been put up on the land in furtherance of the judgement.
