Nii Dr. Kpobi Tettey Tsuru II Wins Land Claims To Amanfrom In A Court Battle

Land litigation between the Plaintiff Nii Dr. Kpobi Tettey Tsuru II and the Defendant James Nii Mensah Okpoti Kodia over lands of Amanfrom village has been ruled in favour of the Plaintiff, Nii Dr. Kpobi Tettey Tsuru II.

In the superior court of judicature in the High Court of Justice Land Court 7 sitting in Accra on Tuesday the 5th day of June 2018 before His Lordship Emmanuel Amo Yartey (J), the Plaintiff represented by Nii Adjetey Lomo accused the Defendant represented by Michael Okpoti Adjei trespassing on part of the Amanfrom Village lands belonging to La Stool, of which the Plaintiff is the occupant of the Stool of La and the Defendant is a subject of the La Stool.

In the ruling of the High Court copied to Peacefmonline.com by the Plaintiff, the Defendant trespassed on the said lands by demolishing buildings constructed thereon, making grants of parts thereof and making claims of ownership of the said Amanfro lands.

The Court however concluded per the evidences and the analyses before it that, the Plaintiff was able to prove his claim to all Amanfrom lands measuring approximately 938.785 bounded on north west by Government land, on the north east by Amrahia and Diary farm on west by Oyarifa land on the south west by Oyarifa and south east by Ahieye and Katamansu lands.

The High Court of Justice Land Court 7 again decree recovery of possession of the said land by the Plaintiff and damages of Ghc50, 000 for trespass against the Defendant in favour of Plaintiff.

Judgment

The brief facts of this case are that the Plaintiff is the occupant of the stool of La and the lawful representative of the said stool and brings this action in that capacity.

The Defendant is a subject of the La Stool and a member of the Kplen family or “We” of the Agbewe Quarters of La currently residing at Oyarifa a village under the La stool.

That both Amafro and the said oyarifa villages like all other La villages were acquiered by the La stool by conquest several centuries ago and were settled on by subjects of the La stool in the case of Amanfro by the Dzrase Quarters and in the case of Oyarifa by the Agbawe Quarter who are the usufractary owners of the lands at Amanfrom and Oyarifa respectively.

According to the plaintiff the Defendant has recently trespassed on part of the said Amanfrom village lands by demolishing buildings constructed thereon, making grants  of parts there and making claims of ownership of the said Amanfrom lands.
