Counsel for Gregory Afoko, Lawyer Nana Yaw Osei has said they will go to court over the new High court ruling that revokes the bail granted to their client who is alleged to have murdered the Upper East Regional Chairman of the New Patriotic Party (NPP), Alhaji Adams Mahama.

According to him, what happened in court on Monday is a shame to the country’s judicial system.

Speaking on Okay FM’s 'Ade Akye Abia' programme, he explained that the ruling came as a surprise to them as their client had been granted bail by a High court, which the police and the Attorney General have failed to comply.

"There is even a contempt case against the Inspector General of Police who has refused to give my client bail, so I am surprised they did not go to court about the contempt case against them."

"However, we will go to a higher court to appeal this case, but this is a clear case of injustice against Mr. Gregory Afoko," he explained.

Background

An Accra High Court presided over by Justice Merley Wood, on Monday, 15 July 2019 quashed the earlier bail granted by another High Court judge, Justice George Buadi in March this year.

Although the suspect met all the bail conditions, the state ignored the court’s ruling and continued to hold the suspect in custody for about three months.

The state, represented by Marina Appiah Opare, on Monday prayed the court to rescind the earlier bail arguing that given the circumstances of the charges and punishment, Mr Afoko, if granted bail, will not appear for the trial.

The court granted the state’s request and reversed the bail, a decision that has sparked public rage with some critics questioning the government’s rule of law credentials.
