KATH CEO Sues Lawyer Adofo For Defamation; Demands GHC5 Million In Damages

Chief Executive Officer of the Komfo Anokye Teaching Hospital, Prof Otchere Addai-Mensah, has sued a private legal practitioner,  Kwame Adofo for defamation.

The plaintiff, per the writ of summons filed at the Kumasi High Court on May 27, 2024, is seeking, among others, general damages of GHC 3 million and exemplary damages of GHC 2 million for malicious conduct.

The plaintiff, per the writ endorsed by Nana Fredua Agyeman Osborn of Osborns Legal, alleges that the defendant, who is a former legal representative for the hospital, commenced tarnishing his image after doing the same to the hospital.

Prof. Otchere notes that lawyer Adofo commenced an attack on the hospital’s image per his defamatory social media posts after the ‘heal Komfo Anokye Project’ launched by the Asantehene.

He adds that owing to the above and the fact that the defendant continued to release information on the hospital, its patients, and general objectives, a complaint was filed at the General Legal Council against him.

As a result of the above, the writ states that the defendant’s contract with the hospital was not renewed when it expired, which even saw him launch a full-scale attack aimed at damaging the hospital’s reputation.

Further to this, the KATH CEO avers that a suit was filed by the hospital against the defendant yet persisted this time by making defamatory statements against his person.

He thus seeks, additionally, a declaration that the words and statements uttered by the defendant on his Facebook timeline are defamatory of his character.

Also, an order directing the defendant to publish an unqualified retraction three consecutive times on his Facebook timeline and in the Daily Graphic.
