Ghana’s Supreme Court has on Thursday, 20 June 2019 dismissed a suit filed by the Chairman of the National Democratic Congress (NDC) in the Ayawaso West-Wuogon constituency, Bismark Aborbi-Ayitey, challenging the date on which the by-election for that constituency was held.
The by-election was held on Thursday, 31 January 2019 but Mr Aborbi-Ayitey, relying on what the constitution says about the timing of the by-election, said in his suit that the date as announced by the Electoral Commission (EC) Chair, Jean Mensa, exceeded the 60-day period in view of the date the seat was declared vacant following the demise of the MP for the area Mr Emmanuel Kyeremateng Agyarko.
However, the apex court, in its ruling stated that the suit by the plaintiff was subject to debate as the election had been held without any move by the plaintiff to stop it through an injunction application.
The plaintiff also in his reliefs did not ask for the annulment of the election and so the court could not go ahead to hear arguments along such lines.

When is said that you don't read you think it is an insult but it is real. Most of the advocates who appear in court do so to have their names mentioned in the GLR or what? What a shoddy work by a lawyer. In fact I am suggesting that lawyers who perform abysmally in practice must be made to undergo a Performance Improvement Program. Meanwhile going to court is not just filing the proceedings. A lot of common sense is required.
